These General Sales Terms apply to all sales agreements of Carnegie Xorel, to the exclusion of the purchasing conditions of the customer.
Prices are NET. Shipping and handling is not included in the Artform Price List. Carnegie reserves the right to change price without notice at any time prior to order confirmation.
All sales tax, use tax, excise tax and other taxes applicable to a sale shall be paid by the purchaser unless appropriate exemption certificates have been submitted to Carnegie.
General Terms Carnegie requires a 50% deposit payment upon the placement of an order. The balance of payment, including invoiced charges not included in our pricing, is due prior to shipment.
The delivery time stated by Carnegie is purely indicative. Delays in delivery may not under any circumstances give rise to any compensation or cancellation of the order.
Credit Terms at its discretion, Carnegie may extend credit terms to accredited customers for the remaining balance of the order. Credit may be established upon completion and review of a credit application and acceptance of satisfactory trade references.
All orders must be ordered by name and color, specifying Xorel Artform shape, substrate, color, and size in the order. All orders must be in writing and must include shipping instructions. All risks of loss or destruction of the goods are to the charge of the customer as of delivery.
Artform is made with ¾” & 1” nominal substrate plus fabric. Carnegie is not responsible for any changes to project site conditions. Minimum order quantity is 1 box of 6 pieces in the same fabric color.
No merchandise may be returned without Carnegie prior written authorization.
Fabric memo samples must be requested by contacting your local Carnegie representative or firstname.lastname@example.org providing project name, specifier and project location.
In the event of disputes the courts of New York shall have sole jurisdiction.
